COVID-Era Penalty Review: The Kwong Update

The National Taxpayer Advocate warned that most taxpayers needed to file refund claims for certain COVID-period penalties and interest by July 10, 2026 to protect their rights under the developing Kwong decision. That date has passed, and the government's appeal is still pending. What matters now is what your IRS account actually shows: whether a protective claim was filed in time and preserved your rights, whether penalties or interest remain unpaid and may still support an abatement request, and whether any recent payment still falls inside its own refund window (generally three years from the return or two years from the payment, whichever is later).
